Terms of Service

These Terms of Service (“Terms”) govern your use of the Mediva mobile application and the website at medivaworld.com (together, the “Service”), provided by Mediva World SL (NIF B88967187), a company registered in Spain with registered office at Calle Lisboa s/n, 38670 Adeje, S.C. Tenerife. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 16 years old to use Mediva. By using the Service you confirm that you are 16 or older and legally able to enter into a binding agreement under the law of your country of residence.
2. Your account
- You are responsible for keeping your login credentials confidential and for all activity that takes place under your account.
- You must provide accurate information when registering and keep it up to date.
- You must notify us immediately at medivaworld@gmail.com if you suspect unauthorised access to your account.
3. Licence to use the Service
Subject to these Terms, Mediva World SL grants you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use Mediva on devices you own or control, solely for your personal, non-commercial use of managing your own medical documents.
4. Your content
You retain all rights in the medical documents, photos, notes, and other materials you upload to Mediva (“Your Content”). You grant Mediva World SL a limited licence to host, store, copy, process, and transmit Your Content solely to provide the features you request (storage, OCR, translation, sharing, export). We do not claim ownership of Your Content and we do not use it to train AI models.
You are responsible for the lawfulness of Your Content and confirm that you have the right to upload it. Do not upload documents that belong to other people without their permission.
5. Medical disclaimer
Mediva is a document-management tool, not a medical device. The Service does not provide medical advice, diagnosis, or treatment, and is not intended to be used in connection with any clinical decision, medication dosing, or emergency. The OCR, translation, and summary features are provided “as is” and may contain inaccuracies. Always consult a qualified healthcare professional for medical questions and rely on original, signed documents from your healthcare provider for clinical decisions.
6. Acceptable use
When using Mediva you agree not to:
- Upload content that infringes intellectual property rights, privacy rights, or any law.
- Upload other people’s medical documents without their authorisation.
- Use the Service to spam, harass, defame, or harm another person.
- Attempt to reverse-engineer, decompile, or circumvent the security of the Service.
- Use automated tools (scrapers, bots) to access the Service except for officially documented APIs.
- Use the Service for any unlawful purpose or in violation of these Terms.
7. Subscriptions and payments
Some features of Mediva may be offered free of charge and others through a paid subscription. Where a subscription applies, pricing, billing, and renewal terms will be presented in the App or on the relevant store listing (App Store or Google Play). Subscriptions purchased through Apple or Google are governed by those platforms’ refund and billing policies, in addition to these Terms.
8. Termination
You may stop using the Service at any time and delete your account from Profile > Settings > Delete account or by emailing medivaworld@gmail.com. See our Delete account page for details.
We may suspend or terminate your access to the Service if you breach these Terms, if required by law, or if continued operation poses a security or legal risk. Where possible we will give you reasonable notice and an opportunity to export Your Content.
9. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure against every possible attack, or that any specific result will be achieved by using it.
10. Limitation of liability
To the extent permitted by law, Mediva World SL’s total liability arising out of or relating to these Terms or the Service is limited to the amount you paid us in the 12 months preceding the event that gave rise to the liability, or EUR 50 if you have not paid us anything. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost goodwill, even if we have been advised of their possibility.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for gross negligence, intentional misconduct, or rights you have as a consumer under Spanish or EU law.
11. Intellectual property
All rights in the Mediva app, the Site, the name “Mediva”, logos, designs, and underlying software are owned by Mediva World SL or its licensors and are protected by intellectual property laws. Nothing in these Terms transfers any of those rights to you, except the limited licence described in section 3.
12. Changes to the Service and these Terms
We may change the Service from time to time, including adding, removing, or modifying features. We may also revise these Terms. If a change materially reduces your rights we will notify you in advance through the App or by email. Continued use of the Service after a change to the Terms means you accept the revised Terms.
13. Governing law and disputes
These Terms are governed by Spanish law. Any dispute arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the competent courts in the Canary Islands, Spain, without prejudice to any mandatory consumer-protection rights you may have under EU law or the law of your country of residence.
